Welcome to Madad! These Terms and Conditions ("Terms") govern your use of the Madad mobile application and website (collectively, the "Platform") and the services facilitated through it. Madad connects users with independent service providers ("Service Partners") for various home and car care services in Muscat, Oman.
By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Platform or our services.
1. Your Relationship with Madad Investment and Business LLC
Madad Investment and Business LLC (referred to as "Madad," "we," "our," or "us") acts solely as a technology platform to connect you, the user, with independent service providers ("Service Partners"). We do not directly provide the services (e.g., car cleaning, house cleaning, repairs) ourselves. Our Service Partners are independent contractors, not employees, agents, or affiliates of Madad Investment and Business LLC. While we strive to onboard reliable professionals, Madad Investment and Business LLC is not responsible for the acts or omissions of any Service Partner.
2. Eligibility and Account
To use Madad, you must be at least 18 years old and capable of forming a legally binding contract.
- Account Creation: You'll need to register for an account using your full name, phone number, and email. You agree to provide accurate, complete, and current information.
- Account Security: You are responsible for maintaining the confidentiality of your account login details and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use.
- Location: Madad services are currently available only within Muscat, Sultanate of Oman.
3. Services and Booking
- Service Descriptions: We strive to provide accurate descriptions of services offered by Service Partners on the Platform. However, Madad Investment and Business LLC do not warrant that descriptions are error-free.
- Booking: All service bookings are made exclusively through the Madad App. You must provide all necessary details for the service (e.g., address, vehicle type, specific requirements).
- Pricing: Prices for services are displayed in Omani Rials (OMR) on the Platform. These prices are set by Madad Investment and Business LLC in consultation with Service Partners. You agree to pay the prices listed at the time of booking. Prices may be subject to change, but changes will not affect confirmed bookings.
- Service Partner Acceptance: A booking is only confirmed once a Service Partner accepts it via the Platform. You'll receive a notification.
- Scope of Work: Services will be performed as described in your booking. Any additional work requested on-site by you that is outside the scope of the original booking may incur extra charges, to be agreed upon directly with the Service Partner and processed through the app if possible.
4. Payments and Cancellations
- Payment Method: Payments for services are processed securely through the Platform using integrated payment gateways. You agree to provide valid payment information.
- Payment Terms: Payment is typically due upon completion of the service, as specified in the app. For certain services (e.g., subscriptions, large projects), upfront payment or a deposit may be required.
- Cancellation Policy:
- User Cancellations: You may cancel a booking through the app. Cancellation fees may apply depending on the timing of your cancellation relative to the scheduled service time. These fees will be clearly communicated in the app.
- Service Partner Cancellations: If a Service Partner cancels a confirmed booking, Madad Investment and Business LLC will make reasonable efforts to find a replacement Service Partner for you. If no replacement is available or acceptable, you will receive a full refund for any pre-paid amounts.
- Refunds: Refunds will be processed according to our Cancellation Policy and any applicable Omani consumer protection laws. Processing times may vary depending on your bank or payment provider.
5. Your Responsibilities
As a user of Madad, you agree to:
- Provide accurate and complete information when booking services.
- Ensure a safe and appropriate environment for Service Partners to perform services, particularly for home services.
- Treat Service Partners with respect and courtesy.
- Comply with all applicable laws and regulations in Oman.
- Only use the Platform for lawful purposes.
6. Service Partner Responsibilities
Service Partners are expected to:
- Perform services with reasonable care and skill.
- Arrive at the scheduled time or communicate any delays promptly.
- Maintain professionalism and courtesy.
- Comply with all relevant safety standards and regulations.
7. Disclaimers and Limitation of Liability
- Platform "As Is": The Madad Platform and services are provided "as is" and "as available," without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Independent Contractors: Madad Investment and Business LLC is not responsible for the quality, safety, or legality of services performed by Service Partners. Any claims related to the services must be directed to the relevant Service Partner.
- Limitation of Liability: To the maximum extent permitted by Omani law, Madad Investment and Business LLC, its affiliates, directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from:
- Your access to or use of, or inability to access or use, the Platform or services.
- Any conduct or content of any third party on the Platform, including any Service Partner.
- Any unauthorized access, use, or alteration of your transmissions or content.
8. Indemnification
You agree to indemnify, defend, and hold harmless Madad Investment and Business LLC, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or in any way connected with:
- Your access to or use of the Platform or services.
- Your breach of these Terms.
- Your violation of any law or the rights of a third party, including any Service Partner.
9. Intellectual Property
All content on the Madad Platform, including text, graphics, logos, icons, images, and software, is the property of Madad Investment and Business LLC or its content suppliers and is protected by Omani and international intellectual property laws. You may not use, reproduce, or distribute any content from the Platform without our express written permission.
10. Privacy
Your use of the Platform is also governed by our Privacy Policy, which outlines how Madad Investment and Business LLC collects, uses, and protects your personal data in accordance with Oman's Personal Data Protection Law (PDPL). 11. Governing Law and Dispute Resolution
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Sultanate of Oman.
- Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall be resolved through amicable negotiation. If a resolution cannot be reached, the dispute shall be referred to the competent courts in Muscat, Sultanate of Oman.
12. Changes to Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of any significant changes by posting the new Terms on the Platform or by email. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
